(Digital products)
Background
JEM Interiors ABN 679 509 845 57 (”JEM Interiors”) is a home colour consultancy service that provides a range of colour matching and customised colour palette designs for residential homeowners/renters based on their needs. These design services will include paint/supplier manufacturers, types of finish, colour codes and where required indicative quantities and a guide on current retail pricing. JEM Interiors also provides digital downloads for homeowners/renters to help guide them through interior design styles and colour to match their preferred styles as well as DIY checklists to consider when selecting your own colour scheme.
This Terms of Sale (the “Agreement“), together with our Privacy Policy and website Terms of Use are the terms and conditions that apply to your (the “Customer“) access to and use of the JEM Interiors ABN 679 509 845 57 online shop and for the supply of products via JEM Interiors ABN 679 509 845 57 website (the “Site“).
Please read this Agreement carefully, as it is legally binding.
By ordering products from the JEM Interiors online shop, you are deemed to have read and accepted the terms of this Agreement.

1. PRODUCTS
1.1. JEM Interiors currently offers the following Digital Products, including but not limited to:
a. Interior Style Colour Guide
b. Renovation Colour Guide
1.2. The Customer may buy or download paid and free digital products offered online by JEM Interiors by navigating the catalogue and shopping cart available by JEM Interiors website.
1.3. To buy and download digital products via JEM Interiors website, the Customer must be at least 18 years of age.
1.4. The Customer confirms that they are at least 18 years of age and that all information they provide is accurate, complete, and not misleading by placing an order.
2. PAYMENTS
You understand and agree:

2.1. All prices are listed in Australian Dollars and include GST.
2.2. All prices are subject to change without notice.
2.3. The full payment for the Customer’s order will be deducted from the Customer’s chosen payment method.
2.4. Payment of fees and products is accepted by <insert the preferred mode of payment, i.e., credit card, bank transfer, PayPal etc.>.
2.5. JEM Interiors does not retain or store any credit card details after payment processing.
3. SPECIAL OFFERS
3.1. JEM Interiors may offer special promotions related to JEM Interiors products from time to time.
3.2. JEM Interiors reserves the right to terminate any special offer without prior notification.
3.3. In the event of termination, any special offer active at the time of the Customer’s purchase will still apply to the digital products the Customer ordered in good faith under these Terms before the special offer was concluded.
4. LICENSE (DIGITAL PRODUCTS)
4.1. Upon purchase of any digital product under this Agreement, including but not limited to eBooks and all PDF downloads (Digital Content), JEM Interiors grants the Customer a perpetual, worldwide, restricted, and non-exclusive license to use such Content for personal use only.
Restrictions
4.2. All downloads are limited to the Customer and the Customer’s electronic devices and must not be shared with any third party.
5. INTELLECTUAL PROPERTY AND COPYRIGHT
5.1. All materials presented on JEM Interiors Site or provided by JEM Interiors, including hard copy books and digital downloads such as PDFs, videos, and audio recordings, are protected by copyright.
5.2. Modifying any of JEM Interiors Content for purposes other than those explicitly intended violates our copyright and proprietary rights and is strictly prohibited.
5.3. The Customer’s use of the Site or JEM Interiors Content does not confer upon you any ownership rights. The ownership remains with JEM Interiors.
5.4. The trademarks, logos, and service marks visible on JEM Interiors Site are the registered or unregistered trademarks owned by JEM Interiors.
5.5. Regardless of registration status, these trademarks may not be employed in connection with any product or service not affiliated with JEM Interiors. Their use should not cause customer confusion or disparage JEM Interiors.
5.6. Nothing on JEM Interiors Site implies granting a license or right to use any trademark without JEM Interiors explicit written consent.
5.7. In the event of a breach of these terms, the Customer acknowledges that damages might not suffice as a remedy. JEM Interiors reserves the right to seek injunctive relief if necessary to prevent violations of its intellectual property rights.
5.8. JEM Interiors as the publisher of the Digital Content, reserves the right to enforce applicable Terms of Use relating to the Digital Content.
6. ALTERATIONS
6.1. These Terms may be subject to modification, and any revised version will be published on JEM Interiors website.
6.2. It is advisable to check JEM Interiors website regularly to remain informed about any updates.
6.3. In the event of modifications, the revised Terms will exclusively apply to products ordered through the JEM Interiors website following the implementation of the changes.
7. Refund Policy
You understand and agree:
7.1. As the products are digitally delivered, refunds do not apply to any purchase or download, except in cases where a breach of the Australian Competition and Consumer Act 2010 has occurred.
8. GOVERNING LAW
8.1. The Terms and Conditions in this Agreement are governed and construed under the laws of the State of Queensland, Australia.
8.2. Each Party irrevocably and unconditionally submits to the exclusive jurisdiction of Queensland, Australia.
